PREPARATION OF THE SITE

Stone restoration is a water-based process. Since some water is necessary to grind, hone and polish stone, Marble Doctor VA, LLC will be responsible for properly protecting vulnerable adjacent surfaces from splatters. Marble Doctor VA, LLC cannot be held responsible for water intrusion into spaces below the work site caused by cracks in the wall or floor not identified prior to work beginning.

The client is responsible for clearing all furniture and all other non-permanent objects which restrict access to the floor or surface being restored. Should some moving be necessary despite this provision, Marble Doctor VA, LLC cannot be held responsible for any damage occurring to any of the client’s belonging.

GUARANTEES

The restoration of stone involves the use of equipment and techniques that can be different and less powerful than those used in stone processing and manufacturing plants. Consequently, the original finish may not be exactly duplicated; however, Marble Doctor VA, LLC guarantees a consistent honed or polished finish that, in many instances can be better than the original.

GENERAL LIMITATIONS

All grinding, honing and polishing equipment used by Marble Doctor VA, LLC works in a rotary mode, therefore tight corners and along the intersection of walls and floors may be inaccessible with these machines. Some limited hand work and smaller machines may be used, if necessary and included in the project, but a typical restoration scope is to restore the damaged portion of the stone. The edges along the walls and corners of a room usually require minimal restoration, since they were not subject to actions that generate wear and tear. By the same principal, baseboards and backsplashes are not part of the restoration work unless specified.

The restoration process is not meant to affect the grout. Sometimes during the honing or polishing phase the grout may become clean but Marble Doctor VA, LLC does not offer any guarantee, written or implied on this subject. Darker colored grout may be discolored by the polishing compound, but such an event is to be considered a rare occurrence. The removal of such discoloration is not guaranteed, nor included in the price of the contract unless specified.

CLEAN UP

It is the responsibility of Marble Doctor VA, LLC to deliver the object of the contract clean. Marble Doctor VA, LLC will remove all tape and plastic used to protect adjacent surfaces and clean splatters that penetrated the protective measures; however, some residual cleaning may need to be performed by the client after Marble Doctor VA, LLC has completed the project. The nature of the splatters produced during the restoration process is mostly water with either stone powder or polishing compound mixed in, therefore, even when dry, this substance will not cause any damage and can easily be removed with a damp cloth.

RESPONSIBILITIES OF MARBLE DOCTOR VA, LLC

Marble Doctor VA, LLC shall complete all work in a competent, skillful manner. Marble Doctor VA, LLC is not responsible for any existing adverse conditions that may be affecting the stone. Marble Doctor VA, LLC will not provide an itemized breakdown of materials and labor for flat rate pricing. However, Marble Doctor VA, LLC will provide an itemized list of all materials used to perform the necessary repair upon request.

LIMITED WARRANTY

Marble Doctor VA, LLC warranties all work to be free from defects in material and workmanship for the warranty period of ninety (90) days from completion unless stated in writing. All warranties are void if payment is not made when due. Warranties extend only to the customer and are not transferrable. If a defect in materials or workmanship covered by this warranty occurs, Marble Doctor VA, LLC will, with reasonable promptness during normal hours, remedy the defect. In no event shall Marble Doctor VA, LLC be held liable for water or other damage caused by any delay in remedying a defect. To obtain warranty performance, notify Marble Doctor VA, LLC of any defect or claims for breach at the address and telephone number on the company’s website.

Exclusions and limitations: Customer’s right to repair is the exclusive remedy and company shall not be liable for incidental or consequential damages resulting from the materials provided for in this contract.

Marble Doctor VA, LLC is not responsible for the following which are excluded from the coverage of this limited warranty:

  1. Work performed by or materials installed by others not in this agreement.
  2. Defects and failures from mistreatment or neglect.

This limited warranty is the only express warranty Marble Doctor VA, LLC gives. Implied warranties, including, but not limited to, warranties of merchantability and fitness for a particular purpose, are limited to duration of ninety (90) days from the date of completion.

CANCELLATION OF A SCHEDULED SERVICE VISIT

If you need to cancel your service, please notify Marble Doctor at info@marbledoctorva.com or by calling 703-631-4625. Service cancellations made within 24 hours of your appointment may be subject to a cancellation fee, up to 10% of the service estimate with a minimum charge of $150.

NOTICE TO OWNER

Under the applicable Mechanics Lien Laws any contractor, subcontractor, laborer or other person who helps to improve your property, but has not been paid for their services or supplies, may have the right to enforce a claim up to and including placing a lien on your property in the event of nonpayment.

ENTIRE AGREEMENT

This is the entire agreement. The parties are not bound by any oral expression or representation by any agent purporting to act for, or on their behalf, or by any commitment or arrangement not set forth herein. The agreement binds jointly and severally all signing as customer, their heirs, representatives, successors, and assigns.
